1. Who you are contracting with

Air2Land is a trading name of MilestoneBrokers LLC, Brooklyn, NY, United States. When you request a quote or tender a shipment, your contract is with MilestoneBrokers LLC acting as a property broker and logistics coordinator. Air transport is arranged through licensed air-cargo partners. Air2Land is not an air carrier and does not operate aircraft.

2. Quotes

• Quotes are estimates based on the information you provide and are not binding until confirmed in writing.
• Rates are subject to change if actual weight, dimensions, cargo type, packaging or timing differ from what was declared.
• Chargeable weight may be calculated on volumetric (dimensional) weight where it exceeds actual weight.
• Quotes exclude duties, taxes, customs charges, storage, demurrage and accessorial charges unless expressly stated.

3. Your obligations as shipper

• You must describe the cargo accurately, including any dangerous goods, and complete the safety declaration truthfully.
• You must package, mark and label cargo to withstand normal air and ground handling.
• You must provide accurate documentation and confirm that the shipment is lawful to transport.
• You are responsible for costs, fines and delays caused by misdeclared, restricted or improperly packed cargo.

4. Carriers and subcontractors

Transportation is performed by licensed air and motor carriers. Each carrier's own tariff, air waybill or bill of lading governs the carriage it performs, including its liability limits.

5. Limitation of liability

Except where prohibited by law, MilestoneBrokers LLC acts as a broker and is not liable as a carrier. Our liability for any claim arising from arranging a shipment is limited to the service fees we charged for that shipment. We are not liable for indirect, incidental or consequential loss, including lost profits, production downtime or missed deadlines. Cargo insurance is available on request and is strongly recommended for high-value or time-critical shipments.

6. No service guarantee

Transit and delivery times are estimates. Air cargo is subject to capacity, security screening, weather, air traffic control, customs and carrier scheduling. No delivery time is guaranteed unless we confirm a guaranteed service in writing for a specific shipment.

7. Claims

• Visible loss or damage must be noted on the delivery receipt at the time of delivery.
• Concealed damage must be reported to us in writing within 5 days of delivery.
• All claims must be filed in writing within 9 months of the date of delivery, or the scheduled delivery date for lost shipments.
• Claims are not accepted while charges for the shipment remain unpaid.

8. Payment

Charges are due on the terms stated on the invoice. Late balances may accrue interest at the maximum rate permitted by law, and we may withhold cargo or documents for unpaid charges to the extent permitted by law.

9. Restricted and prohibited cargo

Certain goods cannot be accepted, or can only be accepted under specific conditions. See our restricted-cargo terms for details. Undeclared dangerous goods may be refused, offloaded and reported to the relevant authorities at your cost.

10. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of law rules, subject to any mandatory federal transportation law.

11. Changes

We may update these terms. The version in force when you submit a request is the version that applies to that request, and we record the version accepted with each submission.
